Terms and Conditions of Sale

  1. Application of terms

These Terms and Conditions of Sale (Terms and Conditions) relate to the purchase of any products (Products) from the AFT Pharmaceuticals Shop website (https://au-shop.aftpharm.com/) (website), or any associated platforms. By accessing the website, registering an account, or purchasing from the Website you automatically agree to these Terms and Conditions. The website Terms of Use, Privacy Policy, Delivery Policy and Returns Policy also form part of these Terms and Conditions and are available on our website.

  1. Parties

“AFT Pharmaceuticals Shop”, “AFT Shop”, “we”, “us” or “our” refers to AFT Pharmaceuticals Limited, a company incorporated in New Zealand. AFT Pharmaceuticals Shop is a trading name of AFT Pharmaceuticals Limited. “You” or “Your” refers to you as the purchaser of the Products and user of the Website.

  1. Product availability and promotions
    1. Product availability is subject to change without notice. Where possible, Product out of stocks are highlighted on the Website.
    2. All special offers and promotions are offered only while stocks last and only for the period of the promotion. Promotional pricing or offers may be withdrawn at any time without notice once available stock is exhausted. AFT Pharmaceuticals Shop may choose to end a promotion early for any reason. Promotional expiry dates and times are listed as New Zealand standard time.
    3. From time to time, we may run short, specific, price promotions without explicit promotion expiry dates in order to clear out stock or achieve other short-term business objectives.
    4. If any Goods are subject to a recall or ban, you agree to follow any reasonable instructions provided by us regarding return or destruction of such Goods and you consent to us contacting you and you agree to inform any end-user of the Goods, including any gift recipient, of any recall applicable to such Goods.
  1. Pricing
    1. The prices displayed on the Website are in Australian dollars and are inclusive of GST. GST is applicable to all orders delivered within Australia.
    2. Any discounts displayed are calculated off the AFT Pharmaceuticals Shop regular sale price.
    3. Prices are subject to change without any notice. We do our best to provide accurate pricing information, but errors can occur from time to time. Where there is a manifest or obvious pricing error, we have the right to refuse or cancel any orders placed for Products incorrectly priced.
  1. Payment and dispatch
    1. Orders will not be dispatched until payment has been received by AFT Pharmaceuticals or any suspected fraud has been investigated.
    2. An order or transaction is not complete until Products are dispatched.
    3. AFT Pharmaceuticals Shop can refuse or cancel any order at its discretion, including without limitation, unavailability of stock or a decision by AFT Pharmaceuticals to no longer sell a Product, and refund payment.

  1. Discount codes
    1. AFT Pharmaceuticals Shop may, at its discretion, choose to offer discount codes to certain customers from time to time. Each discount code will have a clear expiry date and conditions for use. Discount codes cannot be exchanged, or the value used for sales that do not meet the discount code conditions.
    2. The following terms and conditions apply to all discount code promotions, unless stated otherwise in the specific promotion conditions. Additional terms and conditions may apply to a specific promotion, as stated in connection with the promotion:
      1. A customer must meet the discount requirements (as set out in the promotion) to gain the discount code discount.
      2. Discount codes are valid for a limited time only, and unless otherwise specified can only be used by the account holder whom the discount code was offered to by AFT Pharmaceuticals Shop. AFT Pharmaceuticals Shop reserves the right to cancel the order or refuse the discount to customers using discount codes offered to another customer.
      3. AFT Pharmaceuticals Shop reserves the right to modify or cancel a discount code at any time.
      4. A customer can only use one discount code per order.
      5. If the promotion has a minimum purchase requirement, GST and delivery fee will not count toward the minimum purchase amount.
      6. Discount codes are non-transferable and may not be resold or redeemed for cash.
      7. Delivery fee is calculated on the order after discount codes are applied. Codes providing a discount will reduce the subtotal of the order. If this drops below our minimum spend for free delivery, a delivery fee will apply.
      8. If you violate any of discount code terms and conditions, the relevant discount code will be invalid, and the discount will not apply.
  1. Gift with purchase

AFT Pharmaceuticals may choose to offer a gift when a customer purchases a certain Product or Product combination. Free gifts are offered at the discretion of AFT Pharmaceuticals and can end without warning. There will be limited stock of free gifts. If stocks run out, AFT Pharmaceuticals Shop is not liable to offer a replacement.

  1. Prize promotions

From time to time, AFT Pharmaceuticals Shop may run prize promotions on our website or on social channels. Each promotion will have its own terms and conditions which will be available on the Website.

  1. Product labels and expiry dates
    1. All Products supplied to you will have an expiry date. Our policy is to not dispatch any Product within six months of its expiry date, unless otherwise stated on the Product page or where the Product is sold as part of a clearance promotion.
    2. The Product’s expiry date will always be clearly stated on the Product.
    3. Always read the label of any supplements or natural health products you purchase and use only as directed. Vitamins and minerals are supplementary to and not a replacement for a balanced diet. Consult a healthcare professional if symptoms persist.
    4. Please use the Product only for its intended use as described on the Product packaging. We are not liable for any failure to comply with intended uses of the Products, and it is your own responsibility to ensure that any Products, services or information available through our website meet your specific requirements. Please contact the Product manufacturer directly for up-to-date product descriptions or ingredient lists if required.
  1. Warranties & Liability
    1. We pass on any manufacturer warranties with our Products. Otherwise, to the extent lawfully permitted, AFT Pharmaceuticals provides no warranties for any Products purchased except to the extent, it cannot lawfully do so under Australian Consumer Law, unless expressly stated in the Website or if required under Australian Consumer Law.
    2. AFT Pharmaceuticals excludes all liability in respect of any indirect or consequential loss, damage, costs, or expenses incurred by you or anyone else in connection with any Products purchased from the Website or any information provided on the Website.
    3. Where AFT Pharmaceutical’s liability cannot be excluded for any reason, and subject to your rights at law, AFT Pharmaceutical’s maximum aggregate liability in respect of any Products shall not exceed the amount paid by you to AFT Pharmaceuticals in respect of the applicable Product (excluding any amount paid for delivery).
    4. To the maximum extent permitted by law, you agree to release, indemnify and hold AFT Pharmaceuticals and (as applicable) its affiliates, agents, and employees, harmless from and against any claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including legal fees on a full indemnity basis, including for any third party claim, arising from or in relation to your purchase or use of Products or services purchased from the AFT Pharmaceuticals Shop, your use or access of the Website, or any access to the Website by a third party arising out of your breach of these Terms and Conditions, or your violation of any law or the rights of a third party.
    5. Nothing in these Terms and Conditions purports to exclude any rights or remedies in respect of Products under Australian Consumer Law which cannot be excluded, restricted, or modified.
    6. This clause survives termination of these Terms and Conditions.
  1. User submitted content
    1. We reserve the right to use all user submitted content (such as reviews, opinions, and other feedback) in our marketing and promotional material, both on and offline, identifying the submitter by first name only. If you do not want us to use your submitted content, please let us know.
    2. AFT Pharmaceuticals Shop may use, modify, edit or republish any content submitted. While we endeavour not to significantly alter the meaning and intent of submitted content, we do sometimes edit it to condense, summarise, improve readability or comply with our regulatory obligations, and reserve the right to do so.
    3. AFT Pharmaceuticals Shop may refuse to post or remove any submitted content, in whole or in part, from its website or social media platforms, at its sole discretion, including content that violates these terms and conditions or is otherwise objectionable.
    4. You may not be permitted to edit or delete any content you have submitted, but you can ask us to remove the content from online publication, and we will remove it so long as it is reasonably practicable for us to do so.

  1. Governing law

These terms and conditions shall be interpreted in accordance with the laws of Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in Victoria and its appellate courts.  Although the Website may be accessed throughout Australia and overseas, we make no representations or warranties that its content, or the Products, comply with the laws (including intellectual property laws) of any country outside Australia. If you access the Website from outside Australia, you do so at your own risk and are responsible for ensuring compliance with all laws in the place where you are located.  This clause survives termination of these Terms

AFT Pharmaceuticals Shop may amend these Terms and Conditions at any time with immediate effect once uploaded to the Website.
